    The answer is- legal if you purchased the kit from a lawful dealer and you sell the original kit (built or unbuilt)
    but you could not make copies of the kit and sell them built.

    If it is a free kit, it entirely depends on the license the copyright owner grants when he puts it out as free, In accepting a 'free' model you are entering a contract with the copyright holder to abide by the license he grants you. Now he might grant full rights or he might limit the rights...
    For instance The Marvin the Martian model, if you look at the license that comes with the model - it specifically states "not to be sold" So in that case it would be illegal to sell that model you constructed from the kit, no matter how many hours you put in to the build or how much you customized it. Now if you contact the author and he tells you sure, go ahead and sell the models you build from the kit, then you have permission and it would be ok, It would not then be OK for me to do the same thing, I would need to ask for permission also.
