Some designers do not want their models to be repainted, others do not want recoloured models to be posted. You should ask the original designer for permission first before you do something with his / her creation. This is not only a matter of respect. In case of a commercially available model I wouldn't post any recolours unless you have a written permission from the creator or from someone who is authorized to give you permission. Offering a recoloured model without permission may cause serious trouble; you may violate existing copyright laws (which could cause a very costly lawsuit) and / or make the original artist very angry.

The fact that you cannot find a certain commercial model in the web any longer does not mean that it has become free or public domain then. The rights still belong to the creator or authorized persons or companies. It's like a book which is out-of-print or a DVD which has been sold out. The idea behind it still exists and still belongs to the original creator. It is his / her decision and right to publish another edition (or have it published).

I'm not sure about that but it could be possible that the rights might expire after a certain period of time if no-one cares about them; the same happens to movies and books when they are 75 years or older.

In any case, it is safer to ask before.

You can repaint a model for your own personal use. You can't sell it or the completed model, but for your own personal use, that is not a problem. You can also post the build thread of the repainted model, just make a notation that you "are not releasing the model and to not bother asking." :)

That does not mean you can take a scan of a model you found on the web, repaint it, then build it, that is a NO NO!! You must still have obtained the original model legitimately. Repainted scans will not do, and will still be considered piracy. SO if you can't find the model, you might want to move onto something else, just to be clear.

Cristi, if you have specific questions, please, send me a P.M.. O.K.? :)
